With over 25 years of litigation experience exclusively in the field of civil litigation, I have practiced both as plaintiff counsel, as well as in-house defence counsel for some of Canada's largest insurers.
 
I know both sides of a claim -- the needs and motivations of plaintiffs, as well as the business interests and concerns of defendants. And I have practiced from both sides, in hundreds of mediations, in both roles.

MEDIATION STYLE

Some mediators are active in nature -- vigorously highlighting the strengths and weaknesses of each side's case, and aggressively working each party towards compromise. Others are more detached, ferrying offers and counteroffers between parties and content to simply insure all parties' positions are communicated.

I don't limit myself to any one style, communicating positions while at the same time listening, probing and working through the various parties' needs and interests to find a resolution that everyone at the table can agree upon.

It's the approach I appreciated when I represented my clients as a litigator, and I truly believe it is the best approach to maximize success.

WHY MEDIATION?

Our legal system is designed around the idea that every party to a dispute will hire -- at considerable expense -- the best advocate it can afford to advocate for its interests. This battle is drawn out, uncertain and always expensive.

If the parties are compelled to proceed to trial, the expense skyrockets, and the dispute will be settled by someone (or in the case of a jury, several someones) who neither knows the parties nor has any interest in their motivations or needs.

Mediation represents the best alternative for all parties to reach a resolution while still retaining  control over the outcome. It is the least expensive, quickest way to resolve disputes.
